These Terms and Conditions (“Terms”) govern your access to and use of the website www.pinkypromiseclinic.com (“Website”), your communications with us, and the appointment-booking and healthcare-related services offered through or in connection with the Website.

The Website and Pinky Promise Women’s Clinic are operated by PINKY PROMISE HEALTHCARE SERVICES PRIVATE LIMITED, having its registered office and clinic at Second Floor, Maruti Chambers, 202, Veera Desai Road, off New Link Road, Veera Desai Industrial Estate, Andheri West, Mumbai, Maharashtra 400053 (“Pinky Promise”, “Clinic”, “we”, “our” or “us”).

By accessing the Website, submitting an enquiry or lead form, contacting us, booking or attending an appointment, or using any related service, you acknowledge that you have read and agreed to these Terms and our Privacy Policy.
 

1. Scope of Services

Pinky Promise Women’s Clinic provides in-person women’s healthcare and gynaecology services through appropriately qualified and registered healthcare professionals.

Services may include, depending on clinical suitability and availability:

  • Medical consultations;

  • Preventive and routine gynaecological care;

  • Assessment of symptoms and health concerns;

  • Physical or clinical examinations;

  • Recommendations for tests, investigations, medicines or treatment;

  • Follow-up consultations;

  • Referrals to laboratories, imaging centres, hospitals, specialists or other healthcare providers;

  • Appointment-related communication by telephone, SMS, email or WhatsApp; and

  • Other services communicated by the Clinic from time to time.

The availability and suitability of any service are determined by the treating healthcare professional after considering the patient’s symptoms, history, examination and clinical requirements.
 

2. Website Information Is Not Medical Advice

Content available on the Website, advertisements, social-media pages, articles, videos, messages, FAQs or promotional material is provided for general awareness and informational purposes only.

Such content:

  • Does not constitute medical advice, diagnosis, prescription or treatment;

  • Is not a substitute for consultation with a qualified healthcare professional;

  • Should not be used to self-diagnose or delay medical care; and

  • May not apply to your individual health condition.

A doctor-patient relationship is created only when a healthcare professional accepts you for consultation and provides clinical care. Submitting a form, contacting the Clinic, viewing an advertisement or booking an appointment does not, by itself, create a doctor-patient relationship.


3. Medical Emergencies

The Website, appointment forms, WhatsApp number, telephone lines and social-media channels are not emergency medical services.

Do not use these channels for emergencies or time-sensitive conditions. In a medical emergency, immediately contact emergency services, visit the nearest hospital emergency department, or call the appropriate emergency number.

Possible emergency situations may include severe, uncontrollable bleeding, loss of consciousness, severe abdominal or pelvic pain, breathing difficulty, chest pain, seizures, suspected ectopic pregnancy, complications during pregnancy, suicidal thoughts, or any rapidly worsening condition.

The above examples are illustrative and are not an exhaustive list.


4. Eligibility and Minors

You must be legally capable of entering into a binding agreement to use the Website or book services independently.

Where a patient is under the age of 18:

  • A parent or lawful guardian may be required to provide verifiable consent for the processing of the minor’s personal data;

  • The Clinic may require the parent or guardian to be present or provide appropriate authorisation, subject to applicable law and medical ethics;

  • The Clinic may request proof of age, identity or guardianship; and

  • Clinical confidentiality will be handled in accordance with applicable law, professional obligations, patient safety and the best interests of the minor.

Nothing in these Terms restricts a minor’s access to medical care where such care may legally be provided without parental or guardian consent.


5. Appointment Requests and Lead Forms

You may request an appointment by telephone, WhatsApp, the Website, an advertising lead form, or another channel made available by us.

Submitting an appointment request or lead form does not guarantee:

  • Confirmation of an appointment;

  • Availability of a particular doctor;

  • Availability at a preferred date or time;

  • Provision of a particular treatment;

  • A particular medical result; or

  • Acceptance of a patient where the required services are outside the Clinic’s scope.

An appointment is confirmed only after the Clinic expressly communicates confirmation.

You agree to provide accurate, complete and current information. The Clinic will not be responsible for delays, failed communication or clinical issues caused by incorrect, incomplete or withheld information.


6. Communications and Marketing Consent

When you submit an enquiry or appointment form, request a callback, call us, or message us, you authorise the Clinic and its authorised service providers to contact you regarding:

  • Your enquiry;

  • Appointment scheduling or confirmation;

  • Directions and visit instructions;

  • Follow-ups and continuity of care;

  • Test reports or treatment-related communication;

  • Payment or invoice matters;

  • Service updates; and

  • Feedback regarding your experience.

These service-related communications may be sent by telephone, SMS, email, WhatsApp or other reasonable channels and are necessary for responding to your request or delivering services.

Promotional or marketing communications will be sent only where permitted by law and, where required, with your consent. You may withdraw consent for marketing communications at any time by:

  • Using an unsubscribe or opt-out facility;

  • Replying “STOP” where that option is provided;

  • Writing to clinic@askpinkypromise.com; or

  • Contacting the Clinic at +91 7304728721

Withdrawing marketing consent will not affect appointment, treatment, billing, safety or other essential service communications.


7. Advertising and Third-Party Lead Platforms

You may reach the Clinic through advertisements or lead forms hosted by platforms such as Google, Meta, Instagram, Facebook or other advertising partners.

Information submitted through such a platform may first be processed by that platform under its own terms and privacy policy before it is shared with us. Your use of a third-party platform is also governed by that platform’s terms.

Advertisements are intended to communicate the availability of healthcare services and do not:

  • Guarantee cure, treatment success or specific outcomes;

  • Replace a medical consultation;

  • Represent that one doctor, clinic or treatment is universally superior;

  • Guarantee appointment availability; or

  • Establish that a particular treatment is suitable for you.

Any statement regarding experience, services, credentials, pricing, awards, ratings or patient outcomes should be understood subject to its accompanying context, qualification and date.


8. Appointment Attendance and Patient Responsibilities

You agree to:

  • Arrive at the requested time;

  • Carry relevant identification and medical documents;

  • Provide complete and accurate medical, medication, allergy and treatment history;

  • Inform the healthcare professional of pregnancy or possible pregnancy, where relevant;

  • Follow reasonable clinic, infection-control and safety instructions;

  • Treat doctors, staff and other patients respectfully;

  • Avoid recording consultations without prior written consent; and

  • Inform the Clinic promptly if you cannot attend.

The Clinic may refuse, discontinue or reschedule non-emergency services where:

  • A patient behaves abusively, threateningly or unlawfully;

  • Required information or consent is not provided;

  • The requested service is outside the Clinic’s scope;

  • A specialist, hospital or emergency facility would be more appropriate;

  • Payment obligations remain unresolved;

  • Continuing care would be unsafe, unethical or medically inappropriate; or

  • Circumstances beyond the Clinic’s reasonable control affect service availability.

Where reasonably possible, the Clinic will provide appropriate information or referral guidance.


9. Medical Consultation, Examination and Consent

The treating healthcare professional may ask questions, conduct an examination, recommend investigations, discuss treatment alternatives and explain material risks and benefits.

Certain examinations, procedures, investigations, photography, audio-video communication or sharing of records may require separate and specific consent.

You may ask questions and may decline a recommended examination, investigation or treatment. However, refusal may limit the doctor’s ability to diagnose, advise or treat you safely.

No healthcare professional can guarantee a particular medical outcome. Outcomes can vary because of individual health conditions, adherence, biological differences, complications and other factors.


10. Prescriptions and Medicines

Medicines will be prescribed only when considered clinically appropriate by a registered medical practitioner.

You must:

  • Use medicines only as prescribed;

  • Disclose allergies, existing medicines and relevant health conditions;

  • Not share prescriptions or medicines with another person;

  • Seek advice before stopping or modifying prescribed treatment; and

  • Report serious or unexpected reactions promptly.

The Clinic is not responsible for counterfeit, improperly stored, substituted or independently purchased products obtained from unauthorised sources.


11. Diagnostic Laboratories, Pharmacies and Referrals

The Clinic may recommend or facilitate services from third-party laboratories, pharmacies, imaging centres, hospitals, specialists or other providers.

Unless expressly stated otherwise:

  • Such third parties are independent service providers;

  • Their services may be governed by separate terms;

  • They remain responsible for their own services, reports, products, pricing, conduct and data practices; and

  • A recommendation or referral does not constitute a guarantee of their services.

Where necessary for your care and permitted by law, relevant personal and health information may be shared with such providers.


12. Fees, Payments and Taxes

Consultation fees and charges will be communicated before or at the time of service, wherever reasonably practicable.

You agree to pay all applicable:

  • Consultation fees;

  • Procedure or service charges;

  • Test or investigation charges;

  • Medicine or product charges;

  • Cancellation or rescheduling fees, where disclosed; and

  • Taxes or statutory charges.

Charges for third-party services may be payable directly to those providers.

Payments may be processed through third-party payment gateways or banking providers. We do not ordinarily store complete card, UPI PIN or banking authentication details.

Prices may change from time to time. A price displayed in an advertisement, message or Website page may be subject to eligibility, service scope, validity period, doctor recommendation and applicable conditions.


13. Cancellation, Rescheduling and Refunds

Patients should request cancellation or rescheduling at least 2 hours before the appointment.

The following policy will apply:

  • Clinic-initiated cancellation: the patient may choose rescheduling services already provided: consultation or service fees are ordinarily non-refundable once the service has been delivered; and

  • Approved refunds: processed to the original payment method within approximately 7-10 business days, subject to banking and payment-provider timelines.

Refund decisions may also consider medical circumstances, duplicate payments, technical errors and consumer-protection requirements.

Third-party laboratory, pharmacy, hospital or payment-provider refunds are subject to the relevant provider’s policies.


14. Medical Records

The Clinic may create and maintain records relating to your:

  • Identity and contact information;

  • Medical history;

  • Symptoms and examination;

  • Clinical notes;

  • Diagnosis and treatment;

  • Prescriptions;

  • Reports and investigations;

  • Consent;

  • Appointments and communications;

  • Payments and invoices; and

  • Referrals and follow-ups.

Records will be retained for the period required by applicable law, professional standards, patient-safety needs, dispute-resolution requirements and legitimate operational purposes.

Requests for copies of records should be sent to clinic@askpinkypromise.com. We may verify your identity and authority before releasing records. Reasonable administrative charges may apply where legally permissible.

Records may be withheld or redacted only where permitted or required by law, including to protect another person’s confidential information.


15. Privacy and Confidentiality

Our handling of personal and health information is described in the Privacy Policy available on the Website.

Medical information is treated as confidential and is accessed or disclosed only where:

  • Necessary for diagnosis, treatment, continuity of care or clinic operations;

  • You have consented;

  • Required for payment, legal, regulatory, insurance or audit purposes;

  • Necessary to prevent a serious threat to health or safety;

  • Required by a court, law-enforcement agency or competent authority; or

  • Otherwise permitted or required by law.


16. Photography, Recordings and Testimonials

You may not photograph or record doctors, staff, patients, medical records or consultations without prior permission.

The Clinic will not use an identifiable patient photograph, recording, medical story, review or testimonial for advertising or promotional purposes without appropriate consent.

Consent for promotional use will be separate from consent for treatment. Refusing promotional consent will not affect your access to care.

Where you voluntarily post a public review or social-media comment, you acknowledge that it may be publicly visible. The Clinic will avoid publicly confirming sensitive medical details when responding.


17. Intellectual Property

The Website and its content, including its name, logo, text, design, graphics, videos, photographs, illustrations, layout, software and educational material, are owned by or licensed to the Clinic and are protected by applicable intellectual-property laws.

You may view and use the Website for personal, non-commercial purposes. You may not, without written permission:

  • Copy or republish substantial Website content;

  • Modify, sell, license or commercially exploit it;

  • Use the Clinic’s name or logo deceptively;

  • Scrape or systematically extract Website data;

  • Impersonate the Clinic or its healthcare professionals; or

  • Use content in a manner that is misleading, unlawful or harmful.


18. Acceptable Use

You must not:

  • Submit false, fraudulent or misleading information;

  • Attempt unauthorised access to the Website or systems;

  • Upload malware or harmful code;

  • Interfere with Website functionality;

  • Harass doctors, employees or patients;

  • Use the Website for unlawful, abusive or discriminatory purposes;

  • Book appointments for fraudulent or commercial-resale purposes; or

  • Misuse prescriptions, medical certificates or clinic documents.


19. Third-Party Links

The Website may contain links to maps, WhatsApp, social-media pages, payment services, laboratories, pharmacies or other third-party websites.

We do not control and are not responsible for the availability, content, security, accuracy or privacy practices of third-party services. Accessing them is at your discretion and subject to their terms.


20. Website Availability

We aim to maintain the Website but do not guarantee continuous, uninterrupted or error-free availability.

We may modify, suspend or discontinue Website features for maintenance, security, legal, technical or operational reasons.

We are not responsible for failures caused by internet outages, telecommunications providers, third-party platforms, cyber incidents, force majeure events or circumstances beyond our reasonable control.


21. Disclaimer and Limitation of Liability

Nothing in these Terms excludes liability that cannot lawfully be excluded, including liability arising from proven medical negligence, fraud, wilful misconduct or statutory consumer rights.

Subject to applicable law:

  • General Website content is used at your own discretion;

  • We are not liable for decisions made solely on the basis of general Website or advertising content;

  • We are not responsible for independent third-party services;

  • We do not guarantee uninterrupted Website or communication-channel availability; and

  • We do not guarantee specific medical, commercial or appointment outcomes.

Any limitation of liability will apply only to the extent permitted by applicable Indian law.


22. Indemnity

To the extent permitted by law, you agree to indemnify the Clinic against losses arising directly from your unlawful use of the Website, deliberate submission of false information, infringement of intellectual-property rights, misuse of prescriptions or records, or violation of these Terms.

This clause does not apply to losses caused by the Clinic’s own negligence, breach of duty or unlawful conduct.

Nothing in these Terms restricts your right to approach an appropriate medical, consumer, data-protection, judicial or regulatory authority.


24. Changes to These Terms

We may update these Terms to reflect changes in law, clinical practices, Website functionality or business operations.

The revised Terms will be posted on the Website with an updated “Last Updated” date. Material changes may also be communicated through an appropriate channel where required.

Your continued use after an update constitutes acceptance of the revised Terms, except where fresh consent is legally required.


25. Governing Law and Jurisdiction

These Terms are governed by the laws of India.

Subject to applicable consumer-protection law and any mandatory jurisdiction, courts and competent tribunals in Mumbai, Maharashtra will have jurisdiction over disputes arising from these Terms or the Website.

Before commencing formal proceedings, the parties should reasonably attempt to resolve the matter through written communication and good-faith discussion.
 

26. General Provisions

If any provision of these Terms is held invalid or unenforceable, the remaining provisions will continue to apply.

Failure to enforce a provision immediately does not waive the right to enforce it later.

These Terms, together with the Privacy Policy, applicable consent forms, appointment confirmations and service-specific conditions, constitute the agreement governing your use of the Website and relevant services.
